General Prosecutor's Office unveils some details of criminal case against MP Karganbek Samakov

AKIPRESS.COM - Karganbek Samakov The General Prosecutor's Office of Kyrgyzstan unveiled some details of the criminal probe launched against Member of the Parliament Karganbek Samakov, who is accused of organizing a corruption scheme.

In late 2007, Samakov involved persons from his inner circle (relatives, aides and others) to buy out agricultural land in Bishkek's suburb, particularly, located on the territories of Lebedinovsky (134.2 ha) and Baitik (100.0 ha) rural municipalities, as well as to rent agricultural land located on the territory of Kara-Jygach rural municipality (262.3 ha) for their further transfer into the category of “residential areas” and the subsequent sale.

At the initiative of front persons of Samakov, illegal decisions on transformation of the above-mentioned lands were adopted in the period from March to May 2008 by Lebedinovsky, Baitik and Kara-Jygach rural councils.

On August 27, 2008, the National Commission for Land Acquisition decided to return the lands under possession of the Chui regional administration due to significant, unavoidable remarks, i.e. the lands were denied to be transferred.

Once Samakov learned the situation, he entered into an agreement with the former Chairman of the State Security Service, Janybek Bakiyev to carry out their illegal activities. Gaining the support and being confident in the positive resolution of the issue, the MP submitted a written appeal on behalf of his son – Director General of the Raaken Invest Company LLC – in the name of former President Kurmanbek Bakiyev to assist in the land transferring.

To carry out the country's leadership illegal orders, former Vice Prime Minister Iskender Aidaraliyev, who also chaired the National Commission for Land Acquisition, took the obviously illegal decision on transformation of the land virtually owned by Samakov.

As a result of stable illegal communication of Karganbek Samakov with Janybek Bakiyev and other persons in authority, the governmental decree of October 2008 accepted transferring of 262.3 hectares of land from the category of “agricultural land” into the category of “residential areas”, which led to creation of a threat to the interests of the state in ensuring food security, as well as disrupted social relationships ensuring legal activities of the state authorities.

After the MP misappropriated the land, he sold the part of it thus enriching by more than $8 million.

To thank the Bakiyevs, Samakov planned to build luxury houses for former President Kurmanbek Bakiyev, his younger brother Janysh Bakiyev and former Head of the President's Administration Kurmanbek Temirbayev. However, he failed to complete construction of the houses due to the 2010 April events, which resulted into overthrow of the Bakiyevs' regime and their further exile in Belarus.

The General Prosecutor's Office noted that Samakov misled the local population and local authorities while receiving the land, as he promised to attract investment and organize construction of various facilities, including a water park in Baitik rural municipality, a golf club in Lebedinovsky rural municipality, a business center and a luxury residential complex. However, these facilities have never been built and the land was sold to third parties.

On 14 May 2015, the General Prosecutor's Office launched the criminal probe against MP Karganbek Samakov on the charges with corruption and illegal land transfer. On 15 May, he was put into custody.

Legal assessment is expected to be given over the actions of administrations and officials of Kara-Jygach, Baitik and Lebedinovsky rural municipalities, Alamedin district administration, Chui regional administration, National Commission for Land Acquisition and the Government of Kyrgyzstan.
